Welcome to Go Cardio Rentals ("we", "us", "our"). By accessing or using our website and services, you agree to comply with and be bound by the following terms and conditions ("Terms of Service"). Please read these Terms of Service carefully before using our website and services.

1. Acceptance of Terms

By using our website and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

2. Changes to Terms

We reserve the right to modify or update these Terms of Service at any time without prior notice. Your continued use of the website and services after any changes constitutes your acceptance of the new terms.

3. Rental Agreement

By renting equipment from us, you agree to the terms outlined in the rental agreement provided at the time of rental. This includes, but is not limited to, payment terms, rental duration, and the condition and return of the equipment.

4. User Accounts

To access certain features of our services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

5. Payment

All payments for rentals must be made through the methods provided on our website including ShopPay and external payment processing system Stripe. You agree to pay all charges incurred by you or any users of your account and credit card (or other applicable payment mechanisms) at the prices in effect when such charges are incurred.

6. Cancellation and Refunds

Cancellations must be made within 72 hours of full deposit being made. Cancellations after this time will be subject to a $100 cancellation fee. No refunds will be given for rentals once the rental period has started.

7. Use of Equipment

You agree to use the rented equipment in a careful and proper manner and to comply with all laws, ordinances, and regulations relating to the possession, use, or maintenance of the equipment. You are responsible for any damage or loss to the equipment during the rental period.

8. Limitation of Liability

To the maximum extent permitted by law, Go Cardio Rentals shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use our services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our services; or (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party.

9. Indemnification

You agree to indemnify, defend, and hold harmless Go Cardio Rentals, its officers, directors, employees, agents, and affiliates, from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of our services, your violation of these Terms of Service, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity.
